1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your use of the Green Personal Funding website at greenpersonalfunding.com and any funding-matching services we provide. "We," "us," and "our" mean Green Personal Funding, greenpersonalfunding. "You" means the person or business using our website or services.

By using our website, submitting an application or inquiry, or booking a call, you agree to these Terms and our Privacy Policy. If you act on behalf of a business, you confirm you have authority to bind it.

2. What We Do (We Are Not a Lender)

Green Personal Funding helps business owners and real estate investors find financing. We review the information you give us and match you with third-party lenders, funders and lending platforms ("Lending Partners") whose programs you may qualify for.

We are not a lender. We do not make loans, make credit decisions, or set rates, fees or terms. Every application is subject to the Lending Partner's own underwriting, credit review, verification and approval. Each Lending Partner will give you its own agreement, disclosures and terms, which govern any funding you receive.

We may receive compensation from Lending Partners when funding closes. We also charge you a funding fee of 6% to 15% of the amount funded. Your exact fee is set based on the loan type and amount, is shown to you in writing before you accept any offer, and is due only when your funding closes. If you are not funded, you owe us no fee.

3. No Guarantee of Approval or Terms

Pre-qualification, estimates and tools on this website (including the rental DSCR deal check) are for information only. They are not an offer to lend, a commitment to lend, or a guarantee of approval, amount, rate, term or closing timeline.

Available programs depend on factors such as your credit, time in business, revenue, the property, your experience and your location. Some programs are not available in every state.

4. Your Information and Credit Checks

You agree that everything you give us, or a Lending Partner, is true, complete and current, and that you will tell us promptly if it changes. Giving false information to obtain credit may be a crime.

By submitting an application you authorize us and our Lending Partners to obtain consumer and business credit reports and to verify the information you provide, including bank statements, business records and property information. Pre-qualification uses a soft credit inquiry, which does not affect your credit score. A Lending Partner may need a hard inquiry before final approval, and will ask for your permission first.

You authorize us to share your application and documents with Lending Partners for the purpose of finding you funding, as described in our Privacy Policy.

5. Calls, Texts and Emails

By giving us your phone number and email address, you agree that we may contact you about your inquiry or application by phone, text message and email. Message and data rates may apply. Message frequency varies.

We will only send you marketing texts or make marketing calls using an automated system if you have given separate, express written consent, and consent is never a condition of getting funding. You can reply STOP to any text to opt out, and use the unsubscribe link in any marketing email.

6. Fees

There is no cost to submit an inquiry or pre-qualify with us. If you are funded, our funding fee is 6% to 15% of the amount funded, shown to you in writing before you accept and due only when funding closes. Separately, any fees, interest, points or costs for a loan or funding product are set by the Lending Partner and will be shown in their documents before you sign. Read them carefully and ask questions before accepting any offer.

7. Acceptable Use of the Website

You may use this website for lawful purposes only. You may not submit someone else's information without their permission, try to gain unauthorized access, upload malicious code, scrape the site, or copy our content for commercial use. All website content belongs to us or our licensors.

8. Third-Party Sites

Our website may link to Lending Partner applications, calendars and other sites we do not control. Their terms and privacy policies apply when you use them, and we are not responsible for their content or practices.

9. Disclaimer of Warranties

Our website and services are provided "as is" and "as available." To the extent the law allows, we make no other warranties, express or implied, including merchantability, fitness for a particular purpose or non-infringement. General information on this site is not legal, tax or financial advice; talk with your own advisors before making financial decisions.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, including any decision by a Lending Partner to approve, deny or change an application. Our total liability for any claim related to our website or services is limited to the amount you paid us, if any, in the 3 months before the claim arose.

11. Indemnification

You agree to defend and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from inaccurate information you provide, your breach of these Terms, or your violation of any law or third-party right.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The parties will first try to resolve any dispute informally by contacting each other in writing. If it is not resolved within 30 days, it will be handled in the courts located in Santa Clara County, California, unless the parties agree to mediation or arbitration.

13. Changes and General Terms

We may update these Terms by posting a new version on this page with a new "Last updated" date. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. These Terms and our Privacy Policy are the full agreement between you and us about our website and services.
